TERMS AND CONDITIONS
FIRST. GENERALITIES:
This document contains the terms and conditions of use (hereinafter "TCU"), which will be applicable to the acts celebrated and actions executed through, or in direct or indirect relation to, the web portal owned by Incalpaca TPX with RUC Nº 20100226813 (hereinafter "KUNA Stores"), which operates with the domain name https://kunastores.com/ and its related derivatives (hereinafter "The Site").
The TCU contained in this instrument shall apply especially to the following acts and actions: (i) The purchase and sale of the Products through “The Site”; (ii) The access and use of The Site in any way and for any purpose previously authorized by KUNA Stores, unless otherwise expressly agreed in writing; (iii) The access and use of other related spaces that are formed in association or on the occasion of The Site, such as chats, forums, pages, among others. Natural or legal persons duly represented, (hereinafter “the User” or “the Buyer”) who wish to purchase the products of The Site, may do so provided that they register and accept the TCU contained in this document, as well as the other policies and principles that govern The Site and that are incorporated into this document. The TCU are binding and obligatory. In the event that the TCU are not accepted, the person in question will be prohibited from using The Site. The indicated prohibition will be absolute and will refer to direct or indirect use and for any purpose, including access to the Site, the purchase of products offered through it and its related portals, access to information published on the Site, etc.
SECOND. ACCEPTANCE:
Access, use, registration and downloading of information contained on the Site implies full and unreserved acceptance by Users of the TCU.
THIRD. MODIFICATION:
One of the Services offered on the Site is the offer for sale to the general public of Products “Clothing and similar accessories. Stoles, scarves, caps, wallets, purses, backpacks, bags, among other similar products”. This Service will be referred to, hereinafter, as the "Offer".
FOURTH. CAPACITY:
KUNA Stores hereby reserves the right to modify the TCU, policies and conditions of use related to the use and purpose of The Site. KUNA Stores may modify the Terms and Conditions at any time, making this public on The Site. All modified terms will enter into force from the date of their publication on The Site.
FIFTH. THE OFFER:
KUNA Stores, through the Site, will offer the Products for sale, according to the conditions and procedures set forth below: a) During the day(s) that the notice is published on the Site, Buyers and/or Users may place online purchase orders, guaranteeing payment for these through a bank credit card, debit card or any other method that, in the opinion of KUNA Stores, offers sufficient guarantee of payment as expressly defined on the Site; b) The Offers will include the parameters, details and specific conditions of the Products; c) The Offers will have a determined quantity and stock for purchase.
Offers are valid exclusively within the territory of Peru. The photographs and images of the Products, among others, are merely referential.
SIXTH. REGISTER:
The interested User may accept the Offer and purchase it, provided that he/she has previously registered on the Site, for which it is mandatory that all data provided in the form on the Site be valid, true and current. The User is obliged to promptly update the data provided and registered on the Site, to adjust them to the modifications that occur over time. KUNA Stores is not responsible for the accuracy of the data provided by Buyers and/or Users of the Site. Users are responsible, in all cases, for the truthfulness, accuracy, validity and authenticity of the data. KUNA Stores reserves the right to request receipts, backups and/or additional information, in order to corroborate the Personal and Shipping Data, as well as to temporarily or permanently suspend those Users whose data could not be confirmed. In these cases of disqualification, the User will be unable to make Offers, without this generating any right to compensation. The personal information that the User provides to KUNA Stores will be secured by an access code, which only the User will have knowledge of. The User is solely responsible for keeping the Code secret. The User agrees to notify the Company immediately and by suitable and reliable means of any unauthorized use of his or her account. The Account is personal, unique and non-transferable, and it is prohibited for the same User to register or have more than one account. In the event that KUNA Stores detects different Accounts that contain matching or related data, it may cancel, suspend or disable them. KUNA Stores reserves the right to reject any registration request or to cancel a previously accepted registration, at any time and for any reason, without being obliged to communicate or explain the reasons for its decision and without this generating any right to compensation or reimbursement.
SEVENTH. PRICE:
The price of the product will be published in the Offer on the Site, with VAT included.
EIGHTH. PAYMENT :
The User will make the payment by credit or debit cards, bank transfers, or deposits in bank branches or agents authorized by the Site and whose issuing financial institution is a Peruvian credit institution authorized by the Superintendency of Banks and Financial Institutions. For this purpose, the User must inform the expiration date of the card, the three (3) security digits, as well as the name of the cardholder, at the time of placing the order and/or accepting the Offer in question. The proof of purchase of the product will be available and can be viewed on the Website. To avoid any fraud, the User must notify KUNA Stores of any fraudulent movement on the card used to purchase the Offer, by e-mail or telephone, as soon as possible so that KUNA Stores can take the appropriate steps. If there is any bank fraud, KUNA Stores will not be responsible for the amount of the transaction. However, the company will coordinate and do everything within its power between the client, the payment gateway and even with the banks to resolve any financial problems.
The products and services offered on the Site, unless a different form of payment is indicated for particular cases or offers of certain goods or services, may be cancelled using the following payment methods permitted on this site:
Openpay's payment gateway and payment methods include Visa, MasterCard, American Express and Diners credit and debit cards. In addition, bank transfers from BCP, BBVA, Interbank and Scotiabank are allowed; as well as cash payments at these same entities, as well as Kasnet and Tambo Agents.
NINTH. THE SERVICE :
KUNA Stores only sells clothing items. This Service will hereinafter be referred to as the "Offer" that the User may purchase in accordance with the TCU.
The product purchasing process is under the following procedure:

Complete billing information (ID, Department, Province, District)

The User or Buyer clicks the "Continue with contact information" button

Complete the "Information" section (email, first name, last name, address, city, region)

Proceed to click the "Continue with Shipping" button

Choose shipping method (depending on your department/province/district, you can choose between Express Delivery and Regular Delivery)

Proceed to click the "Continue with payment" button

Choose payment method (credit/debit card, bank transfer, payment at bank branch/agent)

choose billing address (same shipping address, or use a different billing address)

Finally, proceed to click on the "Finalize order" button.
TENTH. RESPONSIBILITY :
In no event shall KUNA Stores be liable for: i) any improper use by Users or visitors of the Site of the materials displayed, industrial property rights and intellectual property rights. ii) any damages or eventual losses that may be caused to Buyers and/or Users by the operation of the search tools and errors generated by the technical elements of the Site or search engine. iii) the content of the pages that Buyers or Users may access with or without authorization from KUNA Stores. iv) access by minors or incapacitated persons, under the terms of the corresponding legislation, to the content adhering to the contractual relationship arising from the Site. v) KUNA Stores shall in no event be liable for the loss, misuse or unauthorized use of its validation code, whether by the User and/or Buyer(s) or third parties, after the purchase has been made in the manner expressed in the TCU. The parties also acknowledge and acknowledge that the computer platform provided by KUNA Stores is not infallible, and therefore, during the term of this Agreement, circumstances beyond the control of KUNA Stores may occur, which imply that the Site or the computer platform are not operational for a certain period of time. In such cases, KUNA Stores will endeavour to restore the Site and the computer system as quickly as possible, without any liability being attributed to it. KUNA Stores does not guarantee the availability and continuity of the operation of the Site, nor that, at any time and place, Users may access the Offers of the Site. KUNA Stores is not responsible for viruses or other elements in the content of the Site that may cause alterations in the User's computer system or in the electronic documents stored in the Users' computer systems. KUNA Stores shall not be liable for any damages caused to the Client arising from the inappropriate use of the technologies made available to the Client, regardless of the manner in which these technologies are inappropriately used. KUNA Stores shall not be liable for any damages caused to the Site by improper and bad faith use by Users and/or Buyers. In any case, KUNA Stores' liability, whether contractual, extra-contractual or legal, with Users, Buyers or visitors of the Site, shall not exceed the price actually paid by the Buyer in consideration for the Product.
ELEVENTH. SHIPPING POLICIES :

In order for the shipment of the order placed in the KUNA Perú online store ( https://pe.kunastores.com ) to be carried out successfully, that is, in an appropriate and timely manner, the client must provide the correct information at the time of executing the Purchase Order.
Any incorrect or incomplete data registration that causes improper processing of the same will be the exclusive responsibility of the client. This could even lead to the cancellation of the order if the Company deems it appropriate.
The delivery time of the order is counted from the moment the payment confirmation of the Purchase Order is validated. The extension of said period will depend mainly on the delivery address.

We would appreciate it if you consider that all shipments leave from the City of Lima- Peru, and during the Holiday season (Fiestas Patrias, Christmas and New Year) or campaigns (Black Friday, Cyber Days, Cyber Monday, Online Sale, Summer Sale), there is a probability of a shipping delay of 3 or 4 business days more than normal due to order saturation.
The order must be received by an adult, who will identify himself/herself with his/her full name and National Identity Document (DNI) in physical form and will sign the receipt to confirm compliance with delivery.
The Company will continuously monitor the dispatched orders to ensure that they arrive at their destination within the agreed time. However, delivery may not be completed due to any of the following situations:

The delivery address was not located because its registration on the Platform was carried out in an erroneous or incomplete manner.

No residents were found at the shipping address at the time of delivery.
Once informed of the inconvenience, the Company will contact the Customer by email and/or telephone to reschedule the delivery date. Any additional costs incurred by this rescheduling will be borne by the customer.

BIOSECURITY PROTOCOL (COVID-19):
Our priority is the health of our customers and collaborators, therefore we ask you to take note of the biosecurity protocol that we have implemented in our distribution center where your purchase is processed:

We carry out exhaustive cleaning and disinfection of environments and work areas.

Our employees undergo daily temperature checks, are required to wear personal protective equipment (PPE) to prevent COVID-19, and must wash and disinfect their hands constantly.
Considerations
The Company is exempt from liability, under any circumstances, for any inconvenience that may arise from the provision of product delivery services provided by external suppliers.
Likewise, in the exceptional case that the products purchased by the Client are not in stock, the Client will be sent an email informing the Client of the situation, and the Client will be free to cancel the order or place a new one through the Platform.
TWELFTH. PRODUCT RETURNS OR EXCHANGES :

THIRTEENTH. INTELLECTUAL PROPERTY :
It is expressly stated that the intellectual, commercial and industrial property of the content, designs, graphics, systems, including hardware and software, covered by this Contract are the exclusive property of KUNA Stores. The total or partial reproduction of The Site without the express written permission of KUNA Stores is prohibited. Likewise, the copying, reproduction, adaptation, modification, distribution, commercialization, public communication and/or any other action that constitutes an infringement of the regulations in force in Peru and/or internationally regarding intellectual and/or industrial property, as well as the use of the contents of The Site without the prior express written authorization of KUNA Stores, is strictly prohibited.
FOURTEENTH. RESPONSIBILITY OF THE BUYER AND/OR USER :
Users and/or Buyers are responsible for the information they register on the Site. Therefore, Buyers and/or Users are solely responsible to KUNA Stores and third parties for any consequences that may arise from the use of information for illegal purposes or effects or contrary to these TCU. Likewise, they are exclusively responsible for the loss, misuse or unauthorized use of their validation code, whether by themselves or by third parties, after the purchase has been made in the manner expressed in the TCU.
FIFTEENTH. PERSONAL DATA :
Users and/or Buyers guarantee that the information they provide for the purchase of the product is true, complete, accurate, up-to-date and probable. In accordance with Law 29733, the following is established:
The data provided on the Site will be part of the KUNA Stores database and will be used for the purposes of the contract; to answer your questions, contact you, etc. KUNA Stores assumes that the data has been entered by its owner or by a person authorized by the owner, and that it is correct and accurate. Users and/or Buyers, by accepting these TCU, declare that the personal data provided through the online forms on the KUNA Stores website may be used for subsequent Offers and different from those offered on the Site.
KUNA Stores undertakes not to use personal data provided by users for purposes other than the purchase and sale of products and services online, respecting at all times Law No. 29733 – Personal Data Protection Law and its regulations. Any user who enters their data on the KUNA Stores website is giving their express and unequivocal consent for their data to be used in commercial exchanges carried out through the KUNA Stores website.
