FIRST. GENERALITIES:

This document contains the terms and conditions of use (hereinafter "TCU"), which will be applicable to the acts held and actions carried out through, or in direct or indirect relationship with, the web portal owned by Incalpaca TPX with RUC Nº 20100226813 (hereinafter “KUNA Stores”), which operates under the domain name https://kunastores.com/ and its related derivatives (hereinafter “The Site”).

The TCU contained in this instrument, will apply especially to the following acts and actions: (i) The purchase and sale of the Products through "The Site"; (ii) The access and use of The Site in any way and for any purpose previously authorized by KUNA Stores, unless otherwise expressly agreed in writing; (iii) The access and use of other related spaces that are formed in association or on the occasion of The Site, such as chats, forums, pages, among others. Natural or legal persons duly represented, (hereinafter "the User" or "the Buyer") who wish to purchase the products of The Site, may do so as long as they register and accept the TCUs contained in this document, as well as the other policies and principles that govern the Site and that are incorporated into this document. The TCUs are binding and obligatory. In the event that the TCUs are not accepted, the person in question will be prohibited from using The Site. The indicated prohibition will be absolute and will refer to direct or indirect use and for any purpose, including access to The Site, the purchase of products offered through it and its related portals, access to information published on The Site, etc.

SECOND. ACCEPTANCE:

The access, use, registration and download of information contained in The Site implies the complete and unreserved acceptance by the Users of the TCU.

THIRD. MODIFICATION:

One of the Services offered on The Site is the sale to the general public of Products “Clothing and similar accessories. Stoles, scarves, caps, wallets, purses, backpacks, bags, among other similar products. This Service will be referred to hereinafter as the "Offer".

ROOM. ABILITY:

FIFTH. THE OFFER:

Offers will be valid exclusively within the territory of Peru. The photographs and images of the Products, among others, are merely referential.

SIXTH. RECORD:

The interested User may accept the Offer and acquire it, as long as they are previously registered on The Site, for which it is mandatory that all the data provided in the form on The Site be valid, truthful and current. The User undertakes to update the data provided and registered on The Site in a timely manner, to adjust them to changes that occur over time. KUNA Stores is not responsible for the accuracy of the data provided by the Buyers and/or Users of The Site. Users are responsible, in all cases, for the veracity, accuracy, validity and authenticity of the data. KUNA Stores reserves the right to request receipts, endorsements and/or additional information, in order to corroborate the Personal and shipping Data, as well as to temporarily or permanently suspend those Users whose data could not be confirmed. In these cases of disqualification, the User will be unable to make Offers, without this generating the right to any compensation. The personal information that the User provides to KUNA Stores will be secured by an access code, of which only the User will have knowledge. The User is solely responsible for keeping the Password secret. The User undertakes to notify the Company immediately and by appropriate and reliable means of any unauthorized use of his account. The Account is personal, unique and non-transferable, and it is prohibited for the same User to register or have more than one account. In the event that KUNA Stores detects different Accounts that contain matching or related data, it may cancel, suspend or disable them. KUNA Stores reserves the right to reject any registration request or to cancel a previously accepted registration, at any time and for any reason, without being obliged to communicate or explain the reasons for its decision and without generating any right to compensation. or compensation.

SEVENTH. PRICE:

The price of the product will be published in the Offer on The Site, with VAT included.

EIGHTH. PAYMENT :

The User will make the payment by means of credit or debit cards, bank transfers, or deposits in banking agencies or agents authorized by The Site and that a Peruvian credit establishment authorized by the Superintendence of Banks and Financial Institutions is considered as the issuing financial institution. For this purpose, the User must inform the expiration date of the card, the three (3) security digits, as well as the name of the holder of the card, at the time of placing the order and/or acceptance of the Offer in question. The proof of purchase of the product will be available and can be viewed on the Website. To avoid any fraud, the User must notify KUNA Stores of any fraudulent movement on the card used to purchase the Offer, by e-mail or by telephone, in the shortest possible time so that KUNA Stores can carry out the appropriate procedures. . If there is any bank fraud, KUNA Stores will not be responsible for the amount of the transaction. However, it will carry out the coordination and everything within its reach between the client, the payment gateway and even with the banks to solve any financial problem.

The products and services offered on The Site, unless a different form of payment is indicated for particular cases or offers of certain goods or services, may be canceled using the following means of payment allowed on this site:

Openpay payment gateway, and payment methods include Visa, MasterCard, American Express, and Diners credit and debit cards. In addition, bank transfers from BCP, BBVA, Interbank and Scotiabank are allowed; as well as cash payments in these same entities, in addition to Kasnet and Tambo Agents.

NINETH. THE SERVICE :

KUNA Stores only sells clothing. This Service will be called, hereinafter, the "Offer" that the User can purchase according to the TCU.

The product purchase process is under the following procedure:

  • the User or Buyer clicks the "Checkout" button

  • validate the products in the bag

  • complete billing information (identity document, Department, Province, District)

  • the User or Buyer clicks on the button "Continue with contact information"

  • proceed to click the "Continue shipping" button

  • choose shipping method (depending on your department/province/district, you can choose between Express Delivery and Regular Delivery)

TENTH. RESPONSIBILITY :

In such cases, KUNA Stores will try to restore the Site and the computer system as quickly as possible, without any type of responsibility being attributed to it. KUNA Stores does not guarantee the availability and continuity of the operation of The Site nor that, at any time and time, Users can access the Offers of The Site. KUNA Stores is not responsible for viruses or other elements in the content of The Site that may cause alterations in the User's computer system or in the electronic documents stored in the User's computer systems. ELEVENTH. SHIPPING POLICIES :

In order for the shipment of the order placed in the KUNA Peru online store (kunastores.com/peru) to be carried out successfully, that is, in an adequate and timely manner, the client must enter the correct information when executing the Order Buys.

The registration of erroneous or incomplete data that causes improper processing of the same, will be the sole responsibility of the client. This could even result in a cancellation of the order if the Company deems it appropriate.

The delivery time of the order is counted from the confirmation of the payment of the Purchase Order. The extension of said period will depend mainly on the delivery address.

The KUNA online store includes two forms of delivery:

  • Pick up in store

Cost of shipping:

  • Pick up in store: Free.

  • Home delivery: S/12.00 soles. Free shipping for purchases from S/299.00 soles.

Average delivery time:

  • Lima: 5 - 7 business days

Shipments to the capitals of the main provinces of the following national destinations:

We would appreciate considering that all shipments leave the City of Arequipa-Peru, and in the Holiday season (National Holidays, Christmas and New Year) or campaigns (Black Friday, Cyber ​​Days, Cyber ​​Monday, Online Sale, Summer Sale), there is the probability of shipping delay in 3 or 4 business days more than normal due to the saturation of orders.

The order must be received by an adult, who will be identified with their Full Name and Physical National Identity Document (DNI) and will sign the receipt charge to prove delivery compliance.

The Company will continuously monitor the dispatched orders, in order to ensure that they reach their destination at the agreed time. However, delivery may not take place due to any of the following situations:

  • The delivery address was not located because its registration on the Platform was carried out in an erroneous or incomplete manner.

  • No residents were found at the shipping address at the time of delivery.

Once informed of the inconvenience, the Company will contact the Client via email and/or telephone, to reschedule the delivery date. The additional costs that this rescheduling entails will be assumed by the client.

BIOSECURITY PROTOCOL (COVID-19):

Our priority is the health of our clients and collaborators, for this reason we ask you to take note of the biosafety protocol that we have implemented in our distribution center where your purchase is processed:

  • We carry out exhaustive cleaning, disinfection of environments and work areas.

  • Our collaborators pass a daily temperature control, make mandatory use of personal protective equipment (PPE) for the prevention of COVID-19, and must constantly wash and disinfect their hands.

Considerations

The Company exempts itself from responding, under all circumstances, for possible inconveniences that could be generated by the provision of product delivery services provided by external providers.

Likewise, in the exceptional case that the products purchased by the Customer do not have stock available, an email will be sent informing them of the situation, leaving them free to cancel the order or place a new one through the Platform.

TWELFTH. RETURNS OR EXCHANGES OF THE PRODUCT :

THIRTEENTH. INTELLECTUAL PROPERTY :

It is expressly stated that the intellectual, commercial and industrial property of the content, designs, graphics, systems, including hardware and software, on which this Agreement is concerned are the exclusive property of KUNA Stores. The total or partial reproduction of The Site is prohibited without the express written permission of KUNA Stores. Likewise, copying, reproduction, adaptation, modification, distribution, commercialization, public communication and/or any other action that entails an infringement of current regulations in Peru and/or internationally regarding intellectual and/or industrial property is totally prohibited. , as well as the use of the contents of The Site if it is not with the prior express and written authorization of KUNA Stores.

FOURTEENTH. RESPONSIBILITY OF THE BUYER AND/OR USER :

Users and/or Buyers are responsible for the information they register on The Site. Due to the foregoing, Buyers and/or Users are solely responsible to KUNA Stores and third parties for the consequences that may derive from the use of information for illicit purposes or effects or contrary to this TCU. Likewise, they are exclusively responsible for the loss, misuse or unauthorized use of their validation code, either by themselves or by third parties, after the purchase has been made in the manner expressed in the TCU.

FIFTEENTH. PERSONAL DATA :

The Users and/or Buyers guarantee that the information they provide for the purchase of the product is true, complete, exact, updated and probable. In accordance with Law 29733, the following is established:

The data provided on The Site will form part of the KUNA Stores database and will be used for the purposes of the contract; answer your questions, contact, etc. KUNA Stores presumes that the data has been incorporated by its owner or by a person authorized by it, as well as that it is correct and exact. Users and/or Buyers with the acceptance of these TCU declare that the personal data that they provide through the online forms on the KUNA Stores website can be used for subsequent Offers and different from those offered on The Site.

KUNA Stores undertakes not to use the personal data provided by users for purposes other than the purchase and sale of products and services online, always respecting Law No. 29733 - Personal Data Protection Law and its regulations. Any user who enters their data on the KUNA Stores website is giving their express and unequivocal consent for their data to be used in the commercial exchange carried out through the KUNA Stores website.
